When a tenancy ends and the deposit is withheld, both sides describe a different property. The landlord remembers it clean. The tenant remembers the stain was already there. Neither has anything dated to show.

Malta has a real route to settle this. The Housing Authority Adjudicating Panel costs €10 to file, takes roughly 7 to 20 working days, and needs no lawyer, which means an ordinary tenant actually uses it. And since Act XX of 2024, every lease must already include a signed, photographed inventory. The panel will expect to see one.

    The inspector visits the property for 30 to 40 minutes. Whoever holds the keys lets us in. The landlord and tenant do not both need to attend, so there is no three-way appointment to coordinate.

    Room-by-room condition and cleanliness ratings, dated photographs, meter readings, key count. Issued to every party.

  4. Review and sign within 7 days

    Both parties get 7 days to flag any line and comment. An amendment must be answered in writing; unanswered means accepted. Then the report locks.

Do both the landlord and tenant need to be there?

No. Only whoever gives us access needs to be there. The report is then issued to both parties to review and sign electronically within 7 days. The signature, not a joint walkthrough, is what makes the record binding.

Can I use this at the Housing Authority Adjudicating Panel?

That is what it is built for: a dated, photographed record from an independent third party, with an audit trail showing when it was issued and how each party responded.

Is an inventory report legally required in Malta?

Yes. Since Act XX of 2024 amended the Private Residential Leases Act, every private residential lease in Malta must include an inventory signed by all parties, with photographs and short descriptions recording the condition of the property and any furniture or appliances, even if the property is let unfurnished. The Housing Authority needs it to register the lease. The law does not require the inventory to be independent, so a landlord can produce their own. Our check-in report satisfies the requirement and gives both sides a record that neither of them wrote.

What if the landlord disagrees with the report?

They flag the specific line during the 7-day window and state why. That objection is recorded alongside the original finding, which is stronger evidence than either version alone.
